Referendum on the Twenty-first Amendment of the Constitution (No. 2) Bill 2001

Polling at the referendum took place on Thursday, 7 June 2001. Referendums on the International Criminal Court (Twenty-third Amendment of the Constitution Bill 2001 and on the Treaty of Nice (Twenty-fourth Amendment of the Constitution Bill 2001 also took place on the same day. The subject matter of the referendum was described as follows in a leaflet sent to each elector: ‘BLUE BALLOT PAPER – PROHIBITION OF DEATH PENALTY THE TWENTY-FIRST AMENDMENT OF THE CONSTITUTION (NO. 2) BILL, 2001, proposes to amend – Article 13.6, to delete “, except in capital cases,”; Article 15.5, to insert the following subsection: “2˚ The Oireachtas shall not enact any law providing for the imposition of the death penalty.”; In Article 28.3.3˚, to insert “other than Article 15.5.2˚” after “Constitution”; In Article 40.4, to delete subsection 5˚.’
